Terms of Service

These Terms of Service ("Terms") govern your use of the What's Rolling™ platform at whatsrolling.com (the "Service") operated by Whats Rolling LLC, a Texas limited liability company doing business as "What's Rolling" ("What's Rolling", "we", "us", or "our"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement. Vendor accounts are intended for legitimate mobile and local businesses — for example food, retail, services, entertainment, and community vendors. We reserve the right to refuse or terminate accounts at our discretion.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. You may not share your account or create accounts on behalf of others without their consent.

3. Vendor Responsibilities

Vendors who post location updates, schedules, menus, and announcements ("Vendor Content") are solely responsible for that content. By posting Vendor Content you represent that:

  • The information is accurate and not misleading
  • You have the legal right to operate the business described
  • Your offerings, prices, and promotions comply with applicable health, safety, and consumer protection laws
  • You will not use announcements or push notifications to send spam, harassment, or illegal content

We are a platform, not a party to any transaction between vendors and customers. We are not responsible for the quality of any products or services, order accuracy, vendor availability, or any dispute arising from a vendor-customer interaction.

4. Bookings

Booking requests submitted through the Service are a communication tool between event organizers and vendors. A booking is not confirmed until the vendor explicitly accepts it through the platform. What's Rolling does not guarantee that any vendor will accept, honor, or fulfill a booking. We are not liable for cancellations, no-shows, or disputes arising from bookings.

4a. Bookings, Deposits & Payments

What's Rolling provides software that helps independent vendors and their customers arrange bookings and rentals and, where a vendor chooses, collect a deposit and payments. What's Rolling is not a party to any booking, rental, or payment. All agreements — including price, scope, scheduling, cancellation, and refunds — are solely between the customer and the vendor.

Payments & fees. Payments are processed by Stripe and are made directly to the vendor, who is the merchant of record. What's Rolling does not hold, escrow, or control customer funds and charges no platform fee on these payments. Stripe charges a payment-processing fee per transaction (set by the vendor's own Stripe account); this is Stripe's fee, not What's Rolling's, and is borne by the vendor's account. Your use of payments is also subject to the Stripe Connected Account Agreement. Payouts are controlled by the vendor's own Stripe account and follow Stripe's standard payout schedule.

Vendor eligibility to accept deposits. To collect deposits or payments through the platform, a vendor connects their own Stripe account; identity verification and underwriting are performed by Stripe under the Stripe Connected Account Agreement. What's Rolling does not hold funds, control payouts, or assume liability for the vendor's account, and may make the feature unavailable on a tier or to a vendor at its discretion.

Deposits, refunds & cancellations. A deposit, if required, is set by the vendor and is a down payment toward the vendor's total price (or a standalone booking fee). Each vendor sets and publishes their own cancellation and refund policy, which is shown to the customer before payment and which the customer agrees to at the time of payment. The payment-processing fee is non-refundable: if a payment is refunded, that fee is deducted and the customer is refunded the amount paid less the fee. Refunds are issued solely by the vendor in accordance with their policy. What's Rolling does not decide, guarantee, or issue refunds, and does not mediate disputes between customers and vendors.

Pre-orders (order-ahead for pickup). Where a vendor offers it, customers may order and pay for food or other items ahead of time for pickup at a scheduled stop. The same facilitator terms apply: the vendor is the seller and merchant of record, payment is made directly to the vendor through Stripe, and What's Rolling holds no funds and charges a 0% platform fee. The vendor is solely responsible for the items sold, including preparation, food safety, accuracy, fulfillment, and any refunds. What's Rolling is a discovery and ordering intermediary only and is not the seller of any item.

No guarantee of performance. What's Rolling does not vet, endorse, employ, or supervise vendors and does not guarantee that any vendor will perform a booking, rental, or order. Disputes about payments may be pursued through the customer's card issuer or Stripe's dispute process; because payments are made directly to the vendor, such disputes are resolved against the vendor.

Limitation of liability. To the maximum extent permitted by law, What's Rolling is not liable for any vendor's or customer's acts, omissions, goods, services, cancellations, no-shows, or failure to refund.

5. Reviews

Customers may leave reviews for vendors based on a genuine experience. Reviews are published automatically and are the opinion of the reviewer, not of What's Rolling. We do not edit reviews, and we do not remove a review simply because a vendor disagrees with it or received a low rating.

What we remove. On report, or at our discretion, we may remove a review that:

  • is not based on a genuine customer experience — fake, fraudulent, or posted by the vendor, a competitor, or anyone with a conflict of interest;
  • contains hate speech, harassment, threats, or personal attacks;
  • contains a false statement of fact (as opposed to an honest opinion);
  • discloses someone's private or personal information;
  • is spam, an advertisement, off-topic, or unlawful.

What we don't remove. We do not remove honest reviews just because they are negative, critical, or unflattering, and we do not allow vendors to pay to suppress, alter, or remove reviews. A vendor's recourse to a review they believe is unfair is to reply publicly — a feature we provide on every review.

Vendors must not post fake reviews of their own business, review competitors, or offer compensation in exchange for reviews. Reports are evaluated against this policy; reporting a review does not guarantee its removal.

6. Push Notifications

By opting in to push notifications you consent to receive messages from vendors you follow and from What's Rolling regarding Service updates. You can withdraw consent at any time in your account notification preferences. We include a cooldown period between vendor announcements to prevent notification abuse.

7. Wave Me Down Feature

The Wave Me Down feature is intended to help customers flag down nearby ice cream trucks. Only your street name is shared with the vendor — not your identity, home address, or exact GPS coordinates. By using this feature you consent to this limited location disclosure. Misuse of this feature (e.g. false requests, harassment of vendors) may result in account termination.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate any person, business, or entity
  • Post false, misleading, or fraudulent content
  • Scrape, crawl, or systematically extract data from the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its servers
  • Use the Service to send unsolicited commercial messages

9. Intellectual Property

The What's Rolling name, logo, and platform design are our property. Vendor Content (names, photos, menus, descriptions) remains the property of the vendor. By posting content on the Service you grant us a non-exclusive, royalty-free license to display and distribute that content as part of operating the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT VENDOR INFORMATION (LOCATION, HOURS, MENU) IS ACCURATE OR UP TO DATE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WHAT'S ROLLING? WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, FOOD-RELATED ILLNESS, PROPERTY DAMAGE, OR PERSONAL INJURY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED $100.

12. Indemnification

You agree to indemnify and hold harmless What's Rolling and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your Vendor Content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Collin County, Texas.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or notice on the Service at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time. Termination does not relieve you of obligations incurred prior to termination.
